{"id":236,"date":"2023-11-16T10:33:23","date_gmt":"2023-11-16T10:33:23","guid":{"rendered":"https:\/\/www.feelbox.ro\/bloc\/?p=236"},"modified":"2024-09-18T07:19:29","modified_gmt":"2024-09-18T07:19:29","slug":"obligatiile-angajatorului-eip","status":"publish","type":"post","link":"https:\/\/www.feelbox.ro\/blog\/obligatiile-angajatorului-eip\/","title":{"rendered":"Obliga\u021biile angajatorului legate de echipamentul individual de protec\u021bie (EIP)"},"content":{"rendered":"<p><strong>Echipamentul Individual de Protec\u021bie (EIP)<\/strong>\u00a0include orice tip de echipament conceput pentru a fi utilizat de c\u0103tre lucr\u0103tori cu scopul protej\u0103rii acestora \u00eempotriva diverselor pericole asupra securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103.\u00a0<em>EIP<\/em>\u00a0reprezint\u0103 o m\u0103sur\u0103 de protec\u021bie individual\u0103, care<strong>\u00a0completeaz\u0103<\/strong>\u00a0m\u0103surile de protec\u021bie colectiv\u0103 implementate \u00een cadrul locului de munc\u0103.<\/p>\n<p>Angajatorul poate furniza doar EIP care este \u00een conformitate cu specifica\u021biile de securitate \u0219i s\u0103n\u0103tate, ofer\u0103 protec\u021bie f\u0103r\u0103 s\u0103 prezint\u0103 un pericol major \u00een sine, este ergonomic \u0219i adecvat pentru condi\u021biile relevante.<\/p>\n<p>Conform legisla\u021biei \u00een vigoare,\u00a0<em>angajatorul are obliga\u0163ia de a asigura securitatea \u015fi s\u0103n\u0103tatea lucr\u0103torilor \u00een toate aspectele legate de munc\u0103.\u00a0<\/em>\u00cen acest articol, pute\u021bi descoperi care sunt obliga\u021biile angajatorului referitoare la echipamentul individual de protec\u021bie.<\/p>\n<h2>Tipuri de EIP<\/h2>\n<p>Exist\u0103 o gam\u0103 variat\u0103 de EIP. \u00cen cazul \u00een care se anticipeaz\u0103 accident\u0103ri sau v\u0103t\u0103m\u0103ri la locul de munc\u0103, angajatorul este obligat s\u0103 furnizeze echipament de protec\u021bie pentru:<\/p>\n<h3>Protec\u021bia m\u00e2inilor<\/h3>\n<p>Conform legisla\u021biei \u00een vigoare, angajatorul are obliga\u021bia s\u0103 furnizeze lucr\u0103torilor\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-maini\">m\u0103nu\u0219i de protec\u021bie<\/a>\u00a0corespunz\u0103toare atunci c\u00e2nd ace\u0219tia sunt expu\u0219i la riscuri precum cele mecanice (abraziune, taiere, intepare), fl\u0103c\u0103rile, umiditatea, c\u0103ldura, frigul, toxicitatea sau materialele de lucru caustice sau iritante. M\u0103nu\u0219ile ar trebui s\u0103 fie potrivite pentru purt\u0103tor, s\u0103 fie confortabile \u0219i s\u0103 nu \u00eempiedice desf\u0103\u0219urarea activit\u0103\u021bilor de lucru.<\/p>\n<h4>Standarde pentru m\u0103nu\u0219i de protec\u021bie<\/h4>\n<p><strong>EN 420<\/strong>\u00a0&#8211; Standardul define\u0219te cerin\u021bele generale \u0219i procedurile de \u00eencercare corespunz\u0103toare pentru proiectarea \u0219i fabricarea de m\u0103nu\u0219ilor.<br \/>\n<strong>EN 374-1:2016\u00a0<\/strong>&#8211; Rezisten\u021ba la permeabilitate a m\u0103nu\u0219ilor de protec\u021bie<br \/>\n<strong>EN 374-5:2016<\/strong>\u00a0&#8211; Rezisten\u021ba la penetra\u021bie a m\u0103nu\u0219ilor de protec\u021bie<br \/>\n<strong>EN 388<\/strong>\u00a0&#8211; M\u0103nu\u015fi de protec\u0163ie contra riscurilor mecanice<br \/>\n<strong>EN 407<\/strong>\u00a0&#8211; M\u0103nu\u015fi de protec\u0163ie contra riscurilor termice<br \/>\n<strong>EN 12477<\/strong>\u00a0&#8211; M\u0103nu\u015fi de protec\u0163ie pentru sudur\u0103<br \/>\n<strong>EN 511<\/strong>\u00a0&#8211; M\u0103nu\u0219i de protec\u021bie \u00eempotriva frigulu<br \/>\n<strong>EN 60903<\/strong>\u00a0&#8211; Manusi pentru electricieni &#8211; manusi cu proprietati electroizolante<\/p>\n<h3>Protec\u021bia picioarelor<\/h3>\n<p><img decoding=\"async\" style=\"width: 1002px;\" src=\"https:\/\/www.feelbox.ro\/image\/catalog\/blog_photos\/Obligatiile angajatorului EIP 2.jpg\" \/><\/p>\n<p style=\"font-weight: 400;\">Orice lucr\u0103tor expus riscului de accident\u0103ri ale picioarelor, cauzate de c\u0103deri de obiecte sau de lucrul zone fierbin\u021bi sau foarte reci, trebuie s\u0103 primeasc\u0103\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-picioare\">\u00eenc\u0103l\u0163\u0103minte de protec\u021bie<\/a>\u00a0adecvat\u0103.<\/p>\n<p style=\"font-weight: 400;\">\n\u00cenc\u0103l\u021b\u0103mintea trebuie s\u0103 aib\u0103 propriet\u0103\u021bi care s\u0103 asigure, \u00een func\u021bie de caz, protec\u021bia \u00eempotriva p\u0103trunderii umezelii, materialelor fierbin\u021bi topite\/ incandescente sau materialelor toxice, caustice sau iritante. T\u0103lpile trebuie s\u0103 fie rezistente la uzur\u0103 \u0219i alunecare \u0219i s\u0103 aib\u0103 propriet\u0103\u021bi antistatice.<\/p>\n<p>Lucr\u0103rile de construc\u021bie prezint\u0103 provoc\u0103ri specifice \u00een ceea ce prive\u0219te protec\u021bia picioarelor. Orice lucr\u0103tor, inclusiv \u0219oferii de camioane \u0219i operatorii echipamentelor de munc\u0103, trebuie s\u0103 poarte \u00eenc\u0103l\u021b\u0103minte de protec\u021bie. \u00cenc\u0103l\u021b\u0103mintea de protec\u021bie pentru construc\u021bii, cum ar fi\u00a0<b><strong>bocancii cu\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-picioare\/protectie-tip-s3\">protec\u021bie S3<\/a><\/strong><\/b>\u00a0sau\u00a0<b><strong>cizmele cu\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-picioare\/protectie-tip-s5\">protec\u021bie S5<\/a><\/strong><\/b>, conform standardului EN ISO 20345, trebuie s\u0103 aib\u0103 caracteristici specifice, precum bombeu metalic, , lamel\u0103 metalic\u0103 \u00een talp\u0103 pentru cre\u0219terea nivelului de protec\u021bie la penetrare \u0219i un sistem \u00eencorporat de absorb\u021bie a socurilor \u00een zona tocurilor.<\/p>\n<h3 style=\"font-weight: 500;\">Protec\u021bia capului<\/h3>\n<p style=\"font-weight: 400;\">Conform cerin\u021belor legale, orice lucr\u0103tor care risc\u0103 accident\u0103ri ale capului cauzate fie de c\u0103deri ale obiectelor sau materialelor, fie de mase fluctuante sau ciocniri cu obstacole, trebuie s\u0103 primeasc\u0103\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-cap\">c\u0103\u015fti de protec\u0163ie<\/a>\u00a0adecvate. Aceasta se aplic\u0103 mai ales lucr\u0103torilor din construc\u021bii, celor care lucreaz\u0103\u00a0\u00een apropierea schelelor, \u00een tuneluri \u0219i \u00een apropierea macaralelor.<br \/>\nC\u0103\u0219tile de protectie trebuie s\u0103 fie conforme standardului\u00a0<b><strong>EN 397<\/strong><\/b>, ceea ce inseamna ca a fost testata si a rezistat la impactul cu un obiect de 5 kg eliberat de la 1 m \u00een\u0103l\u021bime.<\/p>\n<h3 style=\"font-weight: 500;\">Protec\u021bia urechilor sau protec\u021bia auditiv\u0103<\/h3>\n<p style=\"font-weight: 400;\">Surzirea cauzat\u0103 de zgomot este boala profesional\u0103 nr. 1 \u00een industria construc\u0163iilor. Din acest motiv, dac\u0103 lucr\u0103torii sunt expu\u0219i zilnic la un nivel de zgomot de peste 85 dB, atunci angajatorul are obliga\u021bia s\u0103 pun\u0103 la dispozi\u021bie echipamente de protec\u0163ie a urechilor:<\/p>\n<ul style=\"font-weight: 400;\">\n<li><a href=\"https:\/\/www.feelbox.ro\/protectie-urechi\/antifoane-interne\">antifoane interne<\/a>\u00a0(dopuri de urechi);<\/li>\n<li><a href=\"https:\/\/www.feelbox.ro\/protectie-urechi\/casti-antifonare\">antifoane externe<\/a>\u00a0(c\u0103\u0219ti de urechi)<\/li>\n<\/ul>\n<h3 style=\"font-weight: 500;\">Protec\u021bia ochilor \u0219i a fe\u021bei<\/h3>\n<p><img decoding=\"async\" style=\"width: 1017px;\" src=\"https:\/\/www.feelbox.ro\/image\/catalog\/blog_photos\/Obligatiile angajatorului EIP 3.jpg\" \/><\/p>\n<p>Angajatorul are responsabilitatea s\u0103 asigure echipament de protec\u021bie lucr\u0103torilor dac\u0103 exist\u0103 un risc de v\u0103t\u0103mare a ochilor sau a fe\u021bei. Riscul poate fi reprezentat de expunerea la substan\u021be chimice periculoase sub form\u0103 de stropi sau vapori, ranirea ochilor cu particule solide \u00een mi\u0219care, praf, \u00a0radia\u021bii sau alte condi\u021bii periculoase. Ochelarii de protec\u021bie trebuie s\u0103 permit\u0103 o vizibilitate bun\u0103 \u0219i s\u0103 limiteze c\u00e2t mai pu\u021bin posibil c\u00e2mpul de vizibilitate.<\/p>\n<h3>Protec\u021bia respira\u021biei<\/h3>\n<p>Atunci c\u00e2nd nivelul de oxigen este prea sc\u0103zut, respectiv sub 17%, angajatorii trebuie s\u0103 se asigure c\u0103 pun la dispozi\u021bie un echipament prin care lucr\u0103torul poate repira aer cu suficient oxigen: fie tub de aer proasp\u0103t legat la exteriorul incintei, fie respirator cu oxigen presurizat. In schimb daca \u00een incint\u0103 ponderea oxigenului este peste 17% atunci se folosesc dispozitive de filtrare. Dispozitivele de filtrare pot fi semim\u0103\u0219ti (acoper\u0103 gura \u0219i nasul) permanente cu filtre sau de\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-respiratorie\/masti-de-protectie-ffp\">m\u0103\u0219ti de unic\u0103 folosin\u021b\u0103<\/a>, sau\u00a0<a href=\"https:\/\/www.feelbox.ro\/protectie-respiratorie\/masti-cu-filtre\">m\u0103\u0219ti complete<\/a>\u00a0cu filtre (acopera gura, nasul, ochii).Pericolele respiratorii nu sunt \u00eentotdeauna evidente, iar expunerea \u00eendelungat\u0103 poate duce la afec\u021biuni respiratorii grave.<\/p>\n<p>Pentru protec\u021bie la praf pute\u021bi alege dintre\u00a0<strong><a href=\"https:\/\/www.feelbox.ro\/protectie-respiratorie\/masti-de-protectie-ffp\">semi-m\u0103\u0219tile FFP1, FFP2 sau FFP3<\/a><\/strong>\u00a0\u0219i\u00a0<strong>m\u0103\u0219tile complete<\/strong>\u00a0(echipamente reutilizabile care acoper\u0103 toat\u0103 fa\u021ba) cu filtre P. Pentru protec\u021bie la vapori nocivi se recomand\u0103\u00a0<b><a href=\"https:\/\/www.feelbox.ro\/protectie-respiratorie\/masti-cu-filtre\">masc\u0103 complet\u0103<\/a><\/b>\u00a0cu\u00a0<b><a href=\"https:\/\/www.feelbox.ro\/protectie-respiratorie\/filtre-pentru-masti\">filtre adecvate<\/a><\/b>\u00a0substan\u021bei pentru care e nevoie de protec\u021bie.<\/p>\n<h2>\u00cembr\u0103c\u0103minte de protec\u021bie \u0219i avertizare sau imbrac\u0103minte de \u00eenalt\u0103 vizibilitate (Hi-Vis)<\/h2>\n<p>\u00cembr\u0103c\u0103mintea de protec\u021bie \u0219i avertizare este special conceput\u0103 pentru a atrage aten\u021bia asupra prezen\u021bei unei persoane \u00eentr-o zon\u0103 periculoas\u0103, contribuind astfel la prevenirea accidentelor. Aceste acte normative ofer\u0103 un cadru legal pentru definirea, clasificarea \u0219i modul de utilizare a EIP.<\/p>\n<p style=\"font-weight: 400;\">\nConform prevederilor legale, angajatorii trebuie s\u0103 asigure EIP adecvate angaja\u021bilor \u00een mod\u00a0<b><strong>gratuit\u00a0<\/strong><\/b>atunci c\u00e2nd riscurile nu pot fi evitate sau limitate suficient prin alte mijloace. Aceast\u0103 obliga\u021bie include asigurarea bunei func\u021bion\u0103ri, \u00eentre\u021binerii \u0219i \u00eenlocuirii EIP, precum \u0219i instruirea angaja\u021bilor \u00een ceea ce prive\u0219te utilizarea corect\u0103 a acestora.<\/p>\n<p style=\"font-weight: 400;\">Potrivit\u00a0<b><strong>articolului 13 din Legea 319\/2006,<\/strong><\/b>\u00a0angajatorilor le revin urm\u0103toarele obliga\u021bii \u00een ceea ce prive\u0219te Echipamentul Individual de Protec\u021bie (EIP):<\/p>\n<ol>\n<li style=\"font-weight: 400;\"><em>b) s\u0103 \u00eentocmeasc\u0103 un plan de prevenire \u015fi protec\u0163ie compus din m\u0103suri tehnice, sanitare, organizatorice \u015fi de alt\u0103 natur\u0103, bazat pe evaluarea riscurilor, pe care s\u0103 \u00eel aplice corespunz\u0103tor condi\u0163iilor de munc\u0103 specifice unit\u0103\u0163ii; (\u2026)<\/em><\/li>\n<li style=\"font-weight: 400;\"><em>l) s\u0103 asigure func\u0163ionarea permanent\u0103 \u015fi corect\u0103 a sistemelor \u015fi dispozitivelor de protec\u0163ie, a aparaturii de m\u0103sur\u0103 \u015fi control, precum \u015fi a instala\u0163iilor de captare, re\u0163inere \u015fi neutralizare a substan\u0163elor nocive degajate \u00een desf\u0103\u015furarea proceselor tehnologice; (\u2026)<\/em><\/li>\n<li style=\"font-weight: 400;\"><em>r) s\u0103 asigure echipamente individuale de protec\u0163ie;<\/em><\/li>\n<li style=\"font-weight: 400;\"><em>s) s\u0103 acorde obligatoriu echipament individual de protec\u0163ie nou, \u00een cazul degrad\u0103rii sau al pierderii calit\u0103\u0163ilor de protec\u0163ie.<\/em><\/li>\n<\/ol>\n<h2 style=\"font-weight: 500;\">Prevederile legale privind obliga\u021biile angaja\u021bilor<\/h2>\n<p><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-family: Arial;\">\u00a0<\/span><\/span><img decoding=\"async\" style=\"width: 768px;\" src=\"https:\/\/www.feelbox.ro\/image\/catalog\/blog_photos\/Obligatiile angajatorului EIP 5.jpg\" \/><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-family: Arial;\">\u00a0<\/span><\/span><\/p>\n<p style=\"font-weight: 400;\">\u00cen cadrul locului de munc\u0103, legisla\u021bia impune anumite obliga\u021bii angaja\u021bilor, \u00een vederea asigur\u0103rii propriei securit\u0103\u021bi \u0219i a celorlal\u021bi:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>s\u0103 utilizeze corespunz\u0103tor echipamentele de lucru \u0219i echipamentele individuale de protec\u021bie (EIP) pe care le-au primit de la angajator;<\/li>\n<li>s\u0103 comunice imediat accidentele suferite la locul de munc\u0103, pentru a permite angajatorului s\u0103 ia m\u0103surile necesare pentru a gestiona situa\u021bia \u0219i a preveni accidentele similare \u00een viitor;<\/li>\n<li>s\u0103 nu procedeze la scoaterea din func\u021biune, modificarea, schimbarea sau \u00eenl\u0103turarea arbitrar\u0103 a dispozitivelor de securitate proprii;<\/li>\n<li>s\u0103 coopereze, at\u00e2t timp c\u00e2t este necesar, cu angajatorul \u015fi\/sau cu lucr\u0103torii desemna\u0163i, pentru a permite angajatorului s\u0103 se asigure c\u0103 mediul de munc\u0103 \u015fi condi\u0163iile de lucru sunt sigure \u015fi f\u0103r\u0103 riscuri pentru securitate \u015fi s\u0103n\u0103tate, \u00een domeniul s\u0103u de activitate;<\/li>\n<li>s\u0103 \u00ee\u015fi \u00eensu\u015feasc\u0103 \u015fi s\u0103 respecte prevederile legisla\u0163iei din domeniul securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103 \u015fi m\u0103surile de aplicare a acestora;<\/li>\n<li>s\u0103 dea rela\u0163iile solicitate de c\u0103tre inspectorii de munc\u0103 \u015fi inspectorii sanitari. [1]<\/li>\n<\/ul>\n<h2 style=\"font-weight: 500;\">Condi\u021biile pe care trebuie s\u0103 le \u00eendeplineasc\u0103 Echipamentele Individuale de Protec\u021bie<\/h2>\n<p style=\"font-weight: 400;\">Pentru a-\u0219i \u00eendeplini scopul, EIP trebuie s\u0103 corespund\u0103 \u00een mod corespunz\u0103tor cu condi\u021biile de munc\u0103. Acest lucru \u00eenseamn\u0103 c\u0103 echipamentul trebuie s\u0103 fie adecvat \u0219i s\u0103\u00a0<b><strong>r\u0103spund\u0103 cerin\u021belor specifice ale mediului de lucru<\/strong><\/b>.<\/p>\n<p>Apoi, echipamentul individual de protec\u021bie trebuie s\u0103 fie\u00a0<b><strong>adaptat caracteristicilor fizice ale lucr\u0103torului<\/strong><\/b>, incluz\u00e2nd dimensiunile corpului, greutatea \u0219i starea de s\u0103n\u0103tate.<\/p>\n<p>Un alt aspect important este ca fiecare pies\u0103 de echipament de protec\u021bie s\u0103 fie\u00a0<b><strong>destinat\u0103 unei singure persoane<\/strong><\/b>\u00a0pentru a preveni transmiterea bolilor \u0219i infec\u021biilor. \u00cen situa\u021bii \u00een care aceast\u0103 regul\u0103 nu poate fi respectat\u0103, se impune respectarea unor norme stricte de igien\u0103 \u0219i s\u0103n\u0103tate.<\/p>\n<h2 style=\"font-weight: 500;\">H.G 1048 \/ 2006<\/h2>\n<p style=\"font-weight: 400;\">Hot\u0103r\u00e2rea de Guvern 1048 \/ 2006 este un act normativ care detaliaz\u0103 utilizarea Echipamentelor Individuale de Protec\u021bie (EIP) \u00een Rom\u00e2nia.
